Terms of Use

These Terms of Use govern access to and use of the WoWines website, operated by WOWINES LTDA, Brazilian company registration (CNPJ) no. 69.186.361/0001-70. By using this site, you fully agree to these terms. If you do not agree, please do not use the site.

1. Purpose

This site sells wines, spirits and alcoholic beverages to adults 18 or older, under applicable Brazilian law, including Brazil's Child and Adolescent Statute (Law No. 8,069/1990), which prohibits selling alcoholic beverages to minors.

2. Registration and user account

To make purchases, you must create an account with a valid phone number and provide truthful information. To receive alcoholic beverages, you must also complete identity and age verification (KYC), as described in item 3. You are responsible for keeping your password confidential and for all activity on your account.

3. Age verification

We only deliver alcoholic beverages to people aged 18 or over. You may place an order before your age and identity verification (KYC) is approved, but an order containing alcoholic beverages is only picked and shipped after your registration is approved. If the verification is not approved, or is not completed within 7 (seven) days, the order is cancelled and the amount paid is refunded in full. Orders containing only non-alcoholic products do not depend on this verification. WoWines reserves the right to refuse or cancel orders whenever there is reasonable doubt about the buyer's legal age.

4. Intellectual property

All content available on this site - including text, product descriptions, photographs, videos, logos, trademarks, layout and source code - is owned by WoWines or its licensors, protected under Brazilian Law No. 9,610/1998 (Copyright Law) and applicable trademark law. Reproduction, distribution, modification or commercial use of any content on this site without prior express written authorization is prohibited.

5. Prohibition on automated data collection and bots

The use of robots, spiders, scrapers, crawlers, data-mining tools, or any other automated means to access, copy, extract, index or replicate, in whole or in part, the content, pricing, product catalog or structure of this site is expressly prohibited without WoWines' prior express authorization. Attempts to circumvent security measures or gain unauthorized automated access may constitute a violation of Brazilian Law No. 12,737/2012 and Law No. 12,965/2014 (Brazilian Civil Rights Framework for the Internet), subjecting the offender to applicable civil and criminal measures, including access blocking and liability for damages.

6. Permitted use of the site

This site is intended solely for personal-consumption purchases. Unauthorized resale of purchased products, as well as commercial use of any site content without authorization, is prohibited.

7. Orders, pricing and payment

Displayed prices may change without prior notice; the price that applies is the one displayed when the order is placed, which is also when stock availability is validated. If any amount changes between the cart being displayed and the confirmation (for example, when a promotion ends), the order is neither completed nor charged, and you are asked to review the amounts before confirming again. WoWines reserves the right to cancel orders in the event of an evident pricing error or stock unavailability, with a full refund where applicable. Under Art. 49 of Brazil's Consumer Protection Code (Law No. 8,078/1990) and Decree No. 7,962/2013, consumers may exercise their right of withdrawal within 7 (seven) calendar days of receiving the product (see section 13).

PIX price and card price. The advertised price is the price for payment via PIX. Payment by credit or debit card carries the card transaction fee, shown on the product page, in the cart and before the order is confirmed. This surcharge applies to the products (after discounts) and gift wrapping, never to shipping.

Product promotions. Products on promotion show the original price struck through next to the promotional price. A promotion is valid only within the stated period; outside it the product returns to its regular price, even if it is already in the cart. Products sold in a bundle (combo) have their own price and do not receive the individual promotion.

Discount coupons. Each coupon has a code, a validity period and, when stated, a total usage limit and/or a limit of one use per customer. One coupon is accepted per order. The coupon discount (percentage or fixed amount) applies only to the products in the order that are not on promotion and are not part of a bundle; promotional prices are not changed, and a fixed-amount discount is capped at the value of those products. Coupons have no cash value, cannot be exchanged or refunded, and do not apply to shipping, gift wrapping or the card fee. If the order is cancelled, not paid in time or returned, the coupon use is released and the coupon can be used again within its validity. WoWines may cancel orders involving improper or fraudulent use of coupons.

Discounts do not stack. When a product qualifies for more than one discount (promotion, coupon or VIP discount), the largest one always applies, with no accumulation (see section 9).

8. Freight and delivery

Freight is calculated based on weight, cargo value and delivery address, and shown before order completion. Delivery times are estimates and may vary by carrier and region.

9. VIP membership program

WoWines may offer a membership (VIP) program, with enrollment subject to WoWines' approval and payment of the membership fee published on the site. The benefits in effect are published on the site and may include: (a) a percentage discount on products, which does not apply to shipping, gift wrapping or the card fee; (b) a monthly credit in reais to use on orders, applied after the other discounts, whose unused balance does not carry over to the following month; and (c) access to members-only products.

The VIP discount does not stack with promotions or coupons: on each product, the largest available discount applies. For example, with a 20% VIP discount and a 10% promotion, the VIP discount applies; with a 5% VIP discount and a 10% promotion, the promotion applies. On products not on promotion, if there is a coupon, the larger of the coupon and the VIP discount applies. Benefits may be changed or discontinued at any time, with reasonable prior notice.

10. Limitation of liability

WoWines is not liable for indirect damages arising from misuse of the site or of purchased products, including the consumption of alcoholic beverages in violation of applicable law. Consumption of alcoholic beverages is the buyer's sole responsibility, and the buyer acknowledges the health risks associated with excessive consumption.

11. Changes to these terms

These Terms of Use may be updated periodically. Continued use of the site after changes constitutes acceptance of the new terms.

12. Governing law and jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The courts of WoWines' registered headquarters have jurisdiction over any disputes, except for consumer venue rules under the Consumer Protection Code.

13. Right of withdrawal and returns

Because purchases are made over the internet, the consumer may withdraw from the purchase within 7 (seven) calendar days of receiving the product, under Art. 49 of Brazil's Consumer Protection Code.

How to request. A return request must be sent by e-mail to sac@wowines.com.br within the period, stating: (a) full name; (b) registered phone number; (c) order number; (d) the product(s) to be returned; and (e) the reason for the return (mandatory in case of a defect, damage or delivery error). Photos are welcome and speed up the review.

Condition of the product. For a return to be accepted, the product must be in the same condition as delivered: label intact and unaltered; seals, closures and capsules intact and unbroken; no marks, scratches or damage to the container caused after delivery; and with its original packaging, where applicable. Products that are opened, consumed, with a damaged or altered label, or with a broken seal cannot be returned under the right of withdrawal. This condition does not affect the consumer's rights in case of a defective product, one damaged in transit, or one delivered that does not match the order.

Review and refund. Once the request is received, WoWines will reply by e-mail with return instructions. Once the return is confirmed as valid, the amount paid, including shipping, will be refunded through the same payment method used for the purchase.

Orders with discounts. The refund corresponds to the amount actually paid for the returned products, after the discounts applied (promotion, coupon or VIP discount), plus shipping in the cases provided for in this section. When the order is returned, the coupon use is released as described in section 7.
