These Terms of Use govern access to and use of the WoWines website. By using this site, you fully agree to these terms. If you do not agree, please do not use the site.

1. Purpose

This site sells wines, spirits and alcoholic beverages to adults 18 or older, under applicable Brazilian law, including Brazil's Child and Adolescent Statute (Law No. 8,069/1990), which prohibits selling alcoholic beverages to minors.

2. Registration and user account

To make purchases, you must create an account with a valid phone number, provide truthful information, and complete identity and age verification (KYC). You are responsible for keeping your password confidential and for all activity on your account.

3. Age verification

No order is completed without approved identity and age verification. WoWines reserves the right to refuse or cancel orders whenever there is reasonable doubt about the buyer's legal age.

4. Intellectual property

All content available on this site - including text, product descriptions, photographs, videos, logos, trademarks, layout and source code - is owned by WoWines or its licensors, protected under Brazilian Law No. 9,610/1998 (Copyright Law) and applicable trademark law. Reproduction, distribution, modification or commercial use of any content on this site without prior express written authorization is prohibited.

5. Prohibition on automated data collection and bots

The use of robots, spiders, scrapers, crawlers, data-mining tools, or any other automated means to access, copy, extract, index or replicate, in whole or in part, the content, pricing, product catalog or structure of this site is expressly prohibited without WoWines' prior express authorization. Attempts to circumvent security measures or gain unauthorized automated access may constitute a violation of Brazilian Law No. 12,737/2012 and Law No. 12,965/2014 (Brazilian Civil Rights Framework for the Internet), subjecting the offender to applicable civil and criminal measures, including access blocking and liability for damages.

6. Permitted use of the site

This site is intended solely for personal-consumption purchases. Unauthorized resale of purchased products, as well as commercial use of any site content without authorization, is prohibited.

7. Orders, pricing and payment

Displayed prices may change without prior notice. Stock availability is validated at the time an order is placed. WoWines reserves the right to cancel orders in the event of an evident pricing error or stock unavailability, with a full refund where applicable. Under Art. 49 of Brazil's Consumer Protection Code (Law No. 8,078/1990) and Decree No. 7,962/2013, consumers may exercise their right of withdrawal within 7 (seven) calendar days of receiving the product.

8. Freight and delivery

Freight is calculated based on weight, cargo value and delivery address, and shown before order completion. Delivery times are estimates and may vary by carrier and region.

9. VIP membership program

WoWines may offer a membership (VIP) program with benefits such as discounts and monthly credit, under the terms in effect as published on the site. Enrollment is subject to WoWines' approval, and benefits may be changed or discontinued at any time, with reasonable prior notice.

10. Limitation of liability

WoWines is not liable for indirect damages arising from misuse of the site or of purchased products, including the consumption of alcoholic beverages in violation of applicable law. Consumption of alcoholic beverages is the buyer's sole responsibility, and the buyer acknowledges the health risks associated with excessive consumption.

11. Changes to these terms

These Terms of Use may be updated periodically. Continued use of the site after changes constitutes acceptance of the new terms.

12. Governing law and jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The courts of WoWines' registered headquarters have jurisdiction over any disputes, except for consumer venue rules under the Consumer Protection Code.
